Texas Federal Judge Reprimands Defense Attorneys Over ‘Blatant AI Slop’ in Court Filings

Olamide

A federal judge in Texas has issued a sharp rebuke to three defense lawyers, accusing them of 'lazy lawyering' and relying on generative AI to produce meritless legal arguments in a voting-related criminal case.

A Judicial Rebuke

A U.S. District Judge in Texas has publicly criticized three defense attorneys for submitting court motions that he described as containing “blatant AI slop.” Judge Mark Pittman issued a stern order denying a request for the release of Khalwinder Singh Bhengura, a 70-year-old defendant currently awaiting sentencing for voting-related offenses. Bhengura, a lawful permanent resident of the United States, was convicted last month of making false claims of citizenship to register to vote and illegally casting a ballot in a federal election.

Allegations of ‘Lazy Lawyering’

In his ruling, Judge Pittman expressed significant concern regarding the quality of the legal arguments presented by Bhengura’s defense team, which consists of attorneys Mario Herrera, Nicole Knox, and Vincent Rene Carrizales. The judge noted that the defense had explicitly disclosed the use of a generative AI tool in the preparation of their motions. However, Pittman characterized the resulting work as “mostly generated by artificial intelligence” and legally flawed.

The judge criticized the attorneys for “subtly bending the law” through arguments he deemed “superficially persuasive but fundamentally meritless.” He further remarked that the “tortured statutory analysis” provided in the motion was so “tone-deaf” that it could only have been produced by an AI tool, adding that most law students would be capable of drafting superior motions.

Defense Response and Justification

The defense team has pushed back against the judge’s characterizations. Lead attorney Nicole Knox stated that the team followed all applicable rules, including the local court mandate requiring the disclosure of AI usage in legal briefs. Knox defended the work, asserting that the “novel approach” taken in their arguments could not have been created by AI alone. She further stated that the defense would not accept “name-calling” or what she described as the arbitrary application of rules.

Attorney Mario Herrera also defended the filings, emphasizing that he personally reviewed and finalized each brief. Herrera argued that the use of AI tools is not inherently misconduct and compared the practice to the long-standing use of templates and drafting software in the legal profession. He maintained that the arguments presented were not frivolous, stating that a disagreement with the court’s interpretation of the law is a standard part of the judicial process that can be addressed through the appeals system.

Potential Sanctions and Future Implications

Judge Pittman indicated that the filings have raised serious questions regarding the attorneys’ ability to practice law. While he expressed an intention to sanction the lawyers, he noted that his current docket does not allow for a hearing before the Thanksgiving holiday. The judge warned that any further “waste of the Court and Government’s limited resources” could result in severe consequences, including the potential for the attorneys to be banned from practicing in the Northern District of Texas.

This incident is part of a broader trend in the United States, where courts are increasingly scrutinizing the use of AI-generated content in legal filings, with several instances already resulting in formal sanctions against legal practitioners.
