Legal Impasse Continues Over Apetumodu Stool Succession
An Osun State High Court has adjourned a lawsuit challenging the replacement of the dethroned Apetumodu of Ipetumodu, Oba Joseph Oloyede, until early 2027 due to procedural disputes over service of process.
The legal dispute surrounding the traditional stool of the Apetumodu of Ipetumodu in Osun State has reached a procedural standstill. According to reports from the Daily Post Nigeria, the Osun State High Court in Ile-Ife has adjourned the case until January 21, 2027, following a disagreement regarding the service of hearing notices to the named defendants.
Background of the Legal Challenge
The lawsuit, filed under case number HIF/50/2026, was brought forward by the dethroned monarch, Oba Joseph Oloyede, alongside several members of the Latimogun Royal Family, including Prince Oyewusi Adewusi, Prince Isaac Adewuni, and Prince Abiodun Oyetoro. The claimants are seeking an interlocutory injunction to prevent the Osun State government from appointing a successor to the throne while the substantive case remains pending.
The legal action names several high-ranking officials and local figures as defendants, including Governor Ademola Adeleke, the Osun State Attorney-General and Commissioner for Justice, the Commissioner for Local Government and Chieftaincy Affairs, as well as local chiefs including Chief Afolabi Adedeji and Chief Adesoye Babalola.
Claims of Due Process Violations
In an application dated September 16, 2026, Oba Oloyede challenged the legality of his removal. The former monarch contends that the state government failed to provide him with notice of any alleged misconduct or an opportunity to respond to allegations prior to the announcement of his deposition. Court documents indicate that Governor Adeleke signed an instrument on May 7, 2026, formalizing the removal of the monarch.
The state government’s decision to depose Oba Oloyede followed his conviction in the United States on charges related to tax fraud and money laundering. However, the claimants argue that the administrative process leading to his removal was flawed, and they are requesting that the court halt any steps toward installing a new traditional ruler until the matter is fully adjudicated.
Procedural Delays in Court
During the most recent proceedings, the court was unable to move forward with the hearing due to a dispute over whether all parties had been properly notified. While counsel for the claimants, O. Ogbewe, stated that the defendants had been served with the necessary court processes, Soji Oyetayo—representing the fifth defendant, Chief Adesoye Babalola—disputed this claim, asserting that he had not received the required hearing notice.
In response to the impasse, Justice Dapo Adeniji issued a ruling to adjourn the case. The court has ordered that fresh hearing notices be issued and served to all defendants to ensure compliance with legal procedures before the next scheduled date in January 2027.
Conclusion
As the legal battle over the Apetumodu stool remains in limbo, the future of the traditional leadership in Ipetumodu hangs in the balance. With the court session pushed into 2027, the status quo regarding the vacant stool is expected to remain unchanged until the judiciary can resolve the procedural disputes and address the substantive arguments regarding the validity of the former monarch’s removal.
