France Considers Legislation to Hold Protesters Financially Liable for Riot Damages

Olamide

The French Senate is debating a contentious bill that would impose heavy financial penalties on demonstrators for damages caused during protests, sparking a national debate over the balance between public order and the right to assembly.

The French Senate began deliberations on Tuesday regarding a legislative proposal that would hold individual protesters financially accountable for damages incurred during street demonstrations. The bill, which has gained significant traction among right-wing and centrist lawmakers, seeks to address the economic fallout from recent periods of civil unrest.

Origins of the Proposal

According to the Daily Post Nigeria, the legislative initiative was initially drafted following riots that occurred in May after the UEFA Champions League final between Paris Saint-Germain and Arsenal. The proposal gained renewed momentum following widespread demonstrations against inequality and the rising cost of living, which resulted in significant violence on October 17. Reports indicate that thousands of businesses were looted or damaged during these events, which have been characterized as some of the most severe unrest in France in recent years.

Key Provisions of the Bill

The proposed legislation introduces several mechanisms to recover costs associated with public disorder:

  • Financial Penalties: Individuals found liable could be ordered to pay up to 10,000 euros for damages caused during protests.
  • Joint Responsibility: The bill establishes financial liability for those who “knowingly participated” in groups formed with the intent to commit vandalism.
  • Dispersal Compliance: Liability may extend to individuals who remain at a gathering after police have issued two formal warnings to disperse.
  • Welfare Seizure: A highly contentious provision allows for the potential seizure of welfare payments and housing assistance to recover costs.

Arguments for and Against

Interior Minister Laurent Nunez has defended the bill, telling parliament that the government must act to ensure that the “vast majority of our fellow citizens” do not bear the financial burden caused by a “minority of vandals.” The bill is expected to pass the upper chamber, supported by a coalition of right-wing and centrist parties, as well as far-right leader Marine Le Pen.

Conversely, the bill faces intense opposition from left-wing lawmakers, trade unions, and advocacy groups. Critics argue that the legislation is an “authoritarian drift” that conflates peaceful protesters with rioters. Communist senator Fabien Gay labeled the bill a “legal travesty,” while a coalition of student organizations and unions warned in Le Monde that the measures would disproportionately impact the poorest families and encourage arbitrary police enforcement. Amnesty International has also publicly urged the government to withdraw the proposal, citing concerns regarding the fundamental right to demonstrate.

Conclusion

As the Senate vote approaches, the debate highlights a deepening divide in French politics regarding the limits of civil protest. While the government maintains that the legislation is a necessary response to protect property and public order, opponents remain concerned that the threat of severe financial repercussions will effectively silence dissent and undermine democratic freedoms.
